Asset Protection Planning

Many of our clients are concerned about protecting their assets during their lifetimes from lawsuits and creditor claims.  We can counsel you on the legal strategies that can protect your assets to the fullest extent possible. 

One way to safeguard assets is through Family Limited Partnerships.  A Family Limited Partnership can help protect your assets from creditors and from people who may sue you.  In addition, contributing family assets to a Family Limited Partnership makes it easier to transfer assets to other family members upon the incapacity or death of a family member.


Estate Planning

Preserving family assets, planning for the needs of loved ones and reducing or eliminating estate taxes (also known as "death taxes") are key goals of estate planning.

Estate planning usually starts with a Will, which contains explicit provisions for the transfer of your property to loved ones after your death.  However, there are other common but important estate planning and elder law documents we can help you prepare, such as:

  • Financial Powers of Attorney to put a trusted person in charge of handing your financial affairs if you become incapacitated.
  • Healthcare Powers of Attorney to put a trusted person in charge of your health care decisions if you become incapacitated.
  • Living Wills, which set out guidelines for dealing with life-sustaining medical procedures in the eventuality you are unable to speak for yourself.
  • Revocable Living Trusts, which protect assets and enable you to transfer them to loved ones without the need for probate.

We also provide advice and counsel about Credit Shelter Trusts, Marital Trusts, Insurance Trusts, Charitable Trusts, Trusts for Minors, and Annual Gifting Programs.


Probate and Estate Administration

If you are named as the administrator or executor of an estate, we can assist you in the legal process of locating all of a decedent's assets, paying legitimate bills, taxes and expenses, and distributing the remainder of the estate to beneficiaries and heirs.  Good legal advice and guidance can expedite the probate process, prevent costly errors, and protect you from being sued.
